Please read these terms carefully before using Aura Sky Pool services

1. Acceptance of Terms

Welcome to Aura Sky Pool Dubai. By accessing our facilities, making a reservation, or using any of our services, you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and Aura Sky Pool, operated at Palm Tower, Palm Jumeirah, Dubai, UAE.

If you do not agree with any part of these terms, you must not use our services or access our facilities. We reserve the right to modify these terms at any time, and your continued use of our services following any changes indicates your acceptance of the new terms.

2. Facility Access and Reservations

2.1 Booking Requirements

All guests must make advance reservations to access Aura Sky Pool. Walk-in access is subject to availability and cannot be guaranteed. Reservations can be made through our official website at auraskypool.com, by phone at +971 52 693 4802, or via email at info@auraskypool.ae.

Important: First-time visitors are eligible for an exclusive discount when booking through our official channels. This offer is non-transferable and valid for one-time use only.

2.2 Age Requirements

Aura Sky Pool is an adults-only facility. All guests must be 21 years of age or older to access the premises. Valid government-issued photo identification will be required upon entry. We reserve the right to refuse entry to anyone who cannot provide adequate proof of age.

2.3 Cancellation and Modification Policy

  • Cancellations made 48 hours or more before the scheduled visit will receive a full refund
  • Cancellations made between 24-48 hours before the visit will receive a 50% refund
  • Cancellations made less than 24 hours before the visit are non-refundable
  • No-shows will forfeit the entire booking amount
  • Modifications to reservations are subject to availability and must be made at least 24 hours in advance

2.4 Capacity and Time Limits

To ensure an exceptional experience for all guests, we maintain strict capacity limits. Standard reservations include a 4-hour access period. Extended stays may be available subject to capacity and additional fees. We reserve the right to limit visit duration during peak periods.

3. Dress Code and Conduct

3.1 Attire Requirements

Aura Sky Pool maintains an upscale atmosphere. Appropriate swimwear is required in pool areas. Cover-ups, resort wear, or smart casual attire is required in dining and lounge areas. The following items are not permitted:

  • Athletic wear, gym clothes, or sports jerseys
  • Torn, excessively worn, or soiled clothing
  • Overly revealing or inappropriate swimwear
  • Footwear with cleats or spikes

3.2 Behavioral Standards

All guests are expected to conduct themselves in a respectful and appropriate manner. The following behaviors are strictly prohibited:

  • Excessive noise, profanity, or disruptive behavior
  • Harassment, discrimination, or intimidation of any kind
  • Running, diving, or horseplay in pool areas
  • Smoking outside designated areas
  • Photography or videography of other guests without consent
  • Bringing outside food or beverages

Zero Tolerance Policy: Aura Sky Pool maintains a zero-tolerance policy for violence, threats, illegal activities, or behavior that compromises the safety and enjoyment of other guests. Violation will result in immediate removal without refund and may result in permanent ban from the facility.

4. Safety and Health Regulations

4.1 Swimming and Pool Safety

The infinity pool is designed for leisure swimming and relaxation. Guests must adhere to all posted safety guidelines and instructions from lifeguards and staff. Children are not permitted in the facility. All guests swim at their own risk.

4.2 Health Requirements

For the safety and comfort of all guests, the following health-related policies apply:

  • Guests with open wounds, bandages, or contagious conditions are not permitted in pool areas
  • Showering before entering the pool is mandatory
  • Guests with known medical conditions that may be affected by swimming should consult their physician before visiting
  • We reserve the right to request guests to leave if they appear intoxicated or under the influence of substances

4.3 Emergency Procedures

In the event of an emergency, guests must follow all instructions from staff immediately. Emergency exits are clearly marked throughout the facility. Trained lifeguards and first aid personnel are on duty during all operating hours.

4.4 Weather-Related Closures

For guest safety, the pool may be temporarily closed during adverse weather conditions including lightning, high winds, or extreme temperatures. In such cases, guests will be offered alternative indoor amenities or the option to reschedule their visit without penalty.

5. Food, Beverage, and Service Policies

5.1 Dining Services

Aura Sky Pool offers premium dining and beverage services featuring signature cocktails, gourmet cuisine, and refreshments. All food and beverage orders are subject to applicable service charges and taxes. Minimum spend requirements may apply during peak periods.

5.2 Alcohol Service

Alcoholic beverages are served in accordance with UAE laws and regulations. Valid identification proving age 21 or older is required. We reserve the right to refuse service to any guest who appears intoxicated. Responsible consumption is expected and encouraged.

5.3 Outside Food and Beverages

Outside food and beverages are strictly prohibited. Exceptions may be made for medical dietary requirements with advance notice and approval from management. Special dietary needs can be accommodated with 48 hours advance notice.

5.4 Service Standards

Our staff is committed to providing exceptional service. However, during peak periods, service times may vary. Gratuities are appreciated but not mandatory. A service charge may be automatically added to food and beverage bills.

6. Payment and Pricing

6.1 Accepted Payment Methods

We accept the following payment methods:

  • Major credit cards (Visa, Mastercard, American Express)
  • Debit cards
  • Digital payment platforms (Apple Pay, Google Pay)
  • Cash (UAE Dirhams only)

6.2 Pricing and Fees

All prices are listed in UAE Dirhams (AED) and are subject to change without notice. Prices displayed on our website and promotional materials are accurate at the time of publication but may be adjusted based on seasonal demand, special events, or operational requirements.

First Visit Discount: New guests receive an exclusive discount on their first visit when booking through official channels. This discount cannot be combined with other offers and is valid for one-time use per person.

6.3 Additional Charges

The following additional charges may apply:

  • Premium cabana or daybed rentals
  • Food and beverage minimum spend requirements
  • Special event or holiday surcharges
  • Late checkout fees
  • Damage or loss of facility property

6.4 Refund Policy

Refunds are processed according to our cancellation policy outlined in Section 2.3. Refunds for eligible cancellations will be issued to the original payment method within 7-10 business days. Service fees and processing charges are non-refundable.

7. Liability and Assumption of Risk

7.1 Assumption of Risk

By accessing Aura Sky Pool facilities, you acknowledge and accept the inherent risks associated with swimming, pool activities, and elevated locations. You agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which might occur as a result of your participation in activities at our facility.

7.2 Limitation of Liability

To the fullest extent permitted by law, Aura Sky Pool, its owners, operators, employees, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

  • Use of our facilities or services
  • Personal injury or property damage
  • Loss or theft of personal belongings
  • Service interruptions or facility closures
  • Acts of nature or circumstances beyond our control

7.3 Personal Property

Aura Sky Pool is not responsible for lost, stolen, or damaged personal property. Secure storage lockers are available for guest use. We strongly recommend that guests do not bring valuable items to the facility. Any items left behind will be held in lost and found for 30 days before disposal.

7.4 Insurance

Guests are encouraged to maintain adequate personal health and travel insurance. Aura Sky Pool's insurance coverage does not extend to personal injuries or property damage sustained by guests except where required by law.

Medical Emergencies: While we maintain trained staff and emergency protocols, guests are responsible for their own medical care and expenses. Emergency medical services will be contacted when necessary, but associated costs are the responsibility of the guest.

8. Photography, Videography, and Media

8.1 Personal Photography

Guests are welcome to take personal photographs and videos for private use. However, photography or videography of other guests without their explicit consent is strictly prohibited. Professional photography equipment, drones, and commercial filming require advance written permission from management.

8.2 Facility Photography

Aura Sky Pool reserves the right to photograph and video record activities within the facility for promotional, marketing, and security purposes. By entering the premises, you consent to being photographed or recorded and grant Aura Sky Pool the right to use such images in promotional materials without compensation.

8.3 Social Media

We encourage guests to share their experiences on social media. When posting, please:

  • Tag @auraskypooldubai and use #AuraSkyPool
  • Respect the privacy of other guests
  • Avoid posting content that could be considered offensive or inappropriate
  • Comply with all applicable platform terms of service

8.4 Intellectual Property

All content, including but not limited to photographs, videos, logos, designs, and written materials produced by or for Aura Sky Pool, is protected by copyright and trademark laws. Unauthorized use, reproduction, or distribution of this content is prohibited.

9. Privacy and Data Protection

9.1 Information Collection

We collect personal information necessary to provide our services, including name, contact details, payment information, and identification documents. This information is collected in accordance with UAE data protection laws and our Privacy Policy.

9.2 Data Usage

Your personal information may be used for:

  • Processing reservations and payments
  • Communicating about your visit and our services
  • Marketing and promotional purposes (with your consent)
  • Improving our services and customer experience
  • Complying with legal obligations

9.3 Data Security

We implement appropriate technical and organizational measures to protect your personal information. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9.4 Third-Party Sharing

We do not sell your personal information to third parties. Information may be shared with service providers necessary for operations (payment processors, booking systems) under strict confidentiality agreements. 10. Special Events and Private Bookings

10.1 Private Events

Aura Sky Pool is available for private events, corporate functions, and special celebrations. Private bookings require advance arrangements and are subject to minimum spend requirements. Contact our events team at info@auraskypool.ae for detailed information and availability.

10.2 Event Terms

Private event bookings are governed by separate event contracts in addition to these Terms of Service. Event-specific terms may include:

  • Minimum guest counts and spending requirements
  • Deposit and payment schedules
  • Cancellation and rescheduling policies
  • Setup and breakdown timeframes
  • Additional service fees and charges

10.3 Special Occasions

During holidays, special events, and peak seasons, modified terms, pricing, and policies may apply. These will be clearly communicated at the time of booking. Special event tickets are typically non-refundable and non-transferable.

11. Accessibility and Accommodations

11.1 Facility Accessibility

Aura Sky Pool is committed to providing accessible facilities. The venue includes elevator access, accessible restrooms, and accommodations for guests with mobility challenges. Please inform us of any specific accessibility needs when making your reservation.

11.2 Service Animals

Certified service animals are permitted in designated areas of the facility in accordance with UAE regulations. Emotional support animals and pets are not permitted. Documentation may be required for service animals.

11.3 Dietary Accommodations

We strive to accommodate dietary restrictions and allergies. Please provide detailed information about dietary requirements at least 48 hours before your visit. While we make every effort to prevent cross-contamination, we cannot guarantee a completely allergen-free environment.

12. Governing Law and Dispute Resolution

12.1 Applicable Law

These Terms of Service are governed by and construed in accordance with the laws of the United Arab Emirates and the Emirate of Dubai. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Dubai.

12.2 Dispute Resolution Process

In the event of any dispute, claim, or controversy, we encourage guests to first contact our management team to seek an amicable resolution. Most concerns can be resolved through direct communication.

12.3 Arbitration

If a dispute cannot be resolved through direct negotiation, both parties agree to submit to binding arbitration in Dubai under the rules of the Dubai International Arbitration Centre (DIAC). The arbitration shall be conducted in English, and the decision shall be final and binding.

12.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Modifications to Terms

Aura Sky Pool reserves the right to modify, amend, or update these Terms of Service at any time without prior notice. Changes will be effective immediately upon posting to our website. Material changes will be communicated to guests with active reservations via email.

Your continued use of our services following any modifications indicates your acceptance of the updated terms. We recommend reviewing these terms periodically to stay informed of any changes. The "Last Updated" date at the top of this document indicates when the most recent revisions were made.

If you do not agree with any modifications to these terms, you must discontinue use of our services and cancel any future reservations in accordance with our cancellation policy.

14. Severability and Waiver

14.1 Severability

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect.

14.2 Waiver

No waiver of any term or condition of these Terms of Service shall be deemed a further or continuing waiver of such term or any other term. Aura Sky Pool's failure to assert any right or provision under these terms shall not constitute a waiver of such right or provision.

14.3 Entire Agreement

These Terms of Service, together with our Privacy Policy and any additional terms provided at the time of booking, constitute the entire agreement between you and Aura Sky Pool regarding the use of our services and supersede all prior agreements and understandings, whether written or oral.

16. Acknowledgment and Acceptance

By making a reservation, accessing our facilities, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety. You confirm that you are at least 21 years of age and have the legal capacity to enter into this binding agreement.
